The Super Committee and Estate Planning

In August, the US Congress passed the Budget Control Act of 2011, which created the Joint Select Committee on Deficit Reduction.  This committee has since come to be known as the “Super Committee” because of the perceived importance of the committee’s charge of issuing a recommendation for $1.5 trillion in deficit reductions over the next decade.  The Super Committee’s recommendation is due on Wednesday, November 23, and will include both proposed spending cuts and tax increases.

How is the Super Committee related to Estate Planning? Because of the significant estate and gift tax decreases implemented in the tax law signed at the very end of 2010, there is plenty of speculation that some of the tax increases will come in the estate and gift tax areas.  Rumors abound of a lowering of the lifetime gift tax exemption from the current $5
million to $1 million.  Today, I even heard that there are also rumors of lowering the estate tax exemption from $5 million to $1 million, which is what the 2010 tax law prevented from happening in the first place.  There are some guesses out there that those changes would take effect as soon as November 23, the date they are announced.  However, few, if any, of the rumors have been confirmed as actual proposals by any of the members of the Super Committee, but the speculation is out there.

When the 2010 tax law increased the estate and gift tax exemption from $1 million to $5 million for 2011 and 2012, it impacted estate planning significantly because most people did not have to include tax planning in their estate plan.  If the Super Committee decides to bring those numbers back down to $1 million, all of a sudden there are tens of thousands of people who must take a look at their estate plan to make sure they are
protected sufficiently so that a large portion of their estate doesn’t go to Uncle Sam when they pass away.  Although everyone can speculate as to what will happen, only the Super Committee actually knows what ideas are being thrown around.  That’s why I’ll be keeping an eye on their recommendation on Wednesday, so I can get it directly from the horse’s mouth.

2nd Annual Wills for Veterans was a HUGE Success!

We are happy toreport that the Dana Law Firm’s 2nd Annual Wills for Veterans was a great success. On Veterans Day, Dana Law Firm opened up all 5 of their Valley location(Scottsdale, Phoenix, Sun City, Mesa, and Chandler) to all Veterans to provide a Free Last Will and Testament!  “I think that the event was a huge success,” says Attorney Matt Dana, the Managing Partner of the firm. “It was great to meet with these Veterans and hear about their experiences. It was very rewarding to be able to give something back to them.” Everyone that attended was so appreciative of the offer. The event had a great turn out and Dana Law Firm did over 120 free Wills for local Veterans, over $36,000 in free legal services! Dana Law Firm was grateful for the opportunity to prepare these Wills to provide a quality plan for their families and loved ones in the future. It was a really rewarding Veteran’s Day to give back to the Veterans that have served us all!

ASU vs. Colorado- Homecoming

Dana Law Firm had the privilege of sponsoring last Saturday’s Homecoming game against Colorado.  This was a great game for Dana Law Firm to sponsor since 5 attorneys are ASU alumni along with all 5 of Matt Dana’s kids.  Matt Dana was interviewed before the game on KTAR 620 AM and a group of us even got to go down on the field to accept the ASU game day ball. We had a great time watching ASU beat Colorado.

Update from Washington Regarding the Estate Tax by Attorney Matthew Dana

Mitt Romney unveiled his economic package today in the Wall Street Journal. Obviously tax reduction was a central theme, including eliminating the estate tax. So, we are back to where we were in the early 2000′s when Bush and Gore squared off. The current estate tax exemption of $5 million is set to expire on 12/31/12. So, where we go from here is still up in the air. Our advice is to go ahead and lock in the $5 million exemption today by creating a trust for the benefit of your spouse. If estate tax is repealed, you lose nothing. If estate tax stays around, you will be glad your locked in the exemption, at low stock and real estate values.
